Marshall Fitness ("Marshall Fitness," "we," "us," or "our") provides online one-on-one fitness coaching. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit marshallfitnesstraining.com (the "Site"), contact us, book a call, purchase a program, or work with us as a coaching client (together, the "Services").

By using the Services, you acknowledge the practices described in this policy. If you do not agree, please do not use the Services.

Information We Collect

We collect information you give us directly, information collected automatically when you use the Site, and information from our service providers.

Information you provide

  • Contact and inquiry information: name, email address, phone number, and anything you include in a form, message, or call booking.

  • Account information: the details you use to set up your client account in our coaching app.

  • Payment information: billing name, address, and payment card details. Payments are processed by Stripe; we do not store full card numbers on our systems.

  • Coaching and fitness information: information you share during intake and weekly check-ins, such as goals, training history, body weight, measurements, progress photos, exercise videos, nutrition and lifestyle habits, consistency ratings, wins, and struggles. You may also choose to share health-related details, such as injuries or conditions relevant to your training.

  • Call and video information: information you share during intro calls, check-in calls, and renewal calls, including audio and video recordings, transcripts, and AI-generated call summaries, plus any feedback videos we send you. We record calls only with your consent, and we tell you at the start of each call that it is being recorded.

  • Communications: messages, emails, and replies you send us.

Information collected automatically

When you visit the Site, our website platform and any analytics tools may collect your IP address, browser and device type, pages viewed, referring site, and approximate location, using cookies and similar technologies. See Cookies and Analytics below.

How We Use Information

We use personal information to:

  • Respond to inquiries and schedule intro and coaching calls.

  • Create and manage your client account.

  • Design, deliver, and adjust your training program, and review your check-ins and progress.

  • Process payments, renewals, and refunds.

  • Send service messages, such as check-in reminders, program updates, and renewal information.

  • Send marketing emails, if you have opted in. You can unsubscribe at any time.

  • Operate, secure, and improve the Site and Services.

  • Comply with legal obligations and enforce our terms.

Health and Fitness Information

Some information you share with us, such as body weight, progress photos, injuries, or health conditions, may be considered health-related or sensitive under certain state laws. We treat it with extra care.

  • We collect it only to provide and personalize your coaching, and only with your consent, which you give when you submit it to us.

  • Progress photos and videos are visible only to you, your coach, and the service providers that host them. We will never post or share your photos, videos, or results publicly without your separate written permission.

  • We do not sell health or fitness information, and we do not use it for targeted advertising.

  • You may withdraw your consent and ask us to delete this information at any time, as described in Your Choices and Rights.

Marshall Fitness is not a healthcare provider, and our coaching is not medical advice. We are generally not a "covered entity" under HIPAA, so HIPAA does not apply to the information you share with us.

How We Share Information

We do not sell your personal information or share it for cross-context behavioral advertising. We share it only as described below.

Legal and safety. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, safety, or property of Marshall Fitness, our clients, or others.

Business transfers. If Marshall Fitness is sold, merged, or reorganized, personal information may transfer to the new owner, who must honor this policy.

With your consent. We may share information for other purposes when you ask us to or agree to it, such as featuring your results as a testimonial.

Cookies and Analytics

The Site uses cookies set by Wix that are needed for the Site to work, such as security and session cookies. We may also use analytics cookies to understand how visitors use the Site, and advertising pixels (such as the Meta Pixel or Google tags) to measure our ads.

When you first visit the Site, a cookie banner lets you accept or decline non-essential cookies. You can also block or delete cookies in your browser settings, though some parts of the Site may not work properly. We honor Global Privacy Control (GPC) signals as a request to opt out of non-essential tracking where required by law.

Data Retention

We keep client information for as long as you are an active client and for up to [2 years] after your program ends, so we can support renewals and answer questions about your history. We keep payment and tax records as long as the law requires. After that, we delete or de-identify the information. You can ask us to delete it sooner.

Security

We use reasonable safeguards to protect personal information, including relying on reputable providers with strong security practices, restricting access to client data, and using secure passwords and two-factor authentication on our accounts. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Your Choices and Rights

You can:

  • Access or correct your information by contacting us or updating it in the coaching app.

  • Delete your information, including progress photos and videos, by contacting us. We may keep some records where the law requires.

  • Opt out of marketing emails using the unsubscribe link in any email.

  • Withdraw consent to our use of your health and fitness information at any time.

Depending on where you live, you may have additional rights under state law, such as the right to know what we collect, to obtain a copy of your data, to opt out of targeted advertising, and to appeal a decision about your request. Residents of states with consumer health data laws, such as Washington and Nevada, have specific rights over health-related information. We will honor these requests where they apply, and we will not discriminate against you for making them.

Children's Privacy

The Services are intended for adults 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.

International Visitors

Marshall Fitness is based in the United States, and our service providers store information in the United States and other countries. If you use the Services from outside the United States, your information will be transferred to and processed in the United States.

Changes to This Policy

We may update this policy from time to time. When we do, we will change the effective date at the top. If changes are significant, we will notify clients by email or through the coaching app.
